Items from the National Collection sometimes display a “copyright status”. This is a term that gives an indication of whether copyright protection applies to the image, and accordingly whether permission should be sought prior to its use. These terms are listed below:

Commonwealth of Australia copyright

This term describes material held in the National Collection, where the copyright protection period is still in force and the copyright owner is the Commonwealth Government.

This can also include Statutory Authorities and other semi-autonomous government agencies operating under their own Acts. This term does not describe material created by State or local Governments.

Australian War Memorial Licensed copyright

This term describes material held in the National Collection where the copyright protection period is still in force and the copyright owner is an individual, company or other party who has retained their copyright in the material but have licensed the Memorial to use the image for certain prescribed in-house purposes.

However, these licenses do not allow the Memorial to grant permission to members of the public. Copyright unknown - orphaned work

This term describes material held in the National Collection where the copyright protection period is still in force and, the copyright owners are unknown and unlikely to ever be determined because the material is extremely old, anonymous, or there is little information on its origin.

Due to the age of the National Collection, this term applies to a significant amount of material, particularly material dating from the First and Second World Wars.

Copyright expired - public domain

This term describes material held in the National Collection that is clearly out of the period of copyright protection.  Material that has passed out of the period of copyright protection is known as being in the “public domain”.
