- Commercial orders: If you are ordering a Collection item for a commercial use, you may need to pay a User Fee. This will vary depending on what you are doing with the item. You will be given options to choose from in the ordering process.

Turnaround times
Allow a 12–14 day turnaround time for all copies of collection items. This is because it takes time to first retrieve archival material – for instance, photographic negatives – and then to process your order. Turnaround time is in addition to delivery time.
Friends Discount
Members of the Australian War Memorial (Friends of the Memorial) will receive a 10% discount on shop and image sales items. To receive your discount, enter your membership number when you sign-in to the Online Shop.
PLEASE NOTE: Friends of the Memorial Membership is intended for use by individuals, families or organisations for personal and non-commercial use of images and shop items.

Glossary
TIFF – Tagged Image Film Format. An uncompressed and lossless image format.
JPEG – Joint Photographic Expert Group. A “lossy” compression image format.
Grayscale – Denoting no colour information. (8 bits denotes 256 shades of grey.)
RGB – Red Green Blue. Denotes colour information. (24 bits denotes 256 shades of each red, green or blue.)
DPI – Dot Per Inch. Relates to the output resolution of a printer device.
PPI – Pixel Per Inch. Relates to input resolutions of cameras and scanners.
Prints
Image quality
The thumbnails shown in the Memorial's online catalogue are representative only of quality and dimension.
Image dimension
The Memorial does not alter the aspect ratio (height versus width) of the historical photographic material. Generally, prints are supplied to the longest dimension as ordered; this ensures that the photographic image is not distorted. This can mean that the delivered print may not be the exact dimensions of the size ordered, and may not necessarily fit conventional frame sizes.
Digital prints (LED)
These are high quality prints for private, non-commercial use only. The image is watermarked. Digital prints are produced on photographic material by the exposure of digital information via an LED (Light Emitting Diode) light source.
Print Resolution: 254 DPI (Dots Per Inch).
Surfaces: Gloss.
Image
Permanence: Typically more than 40 years, subject to storage conditions.

Inkjet prints
These are high quality prints suitable for display and exhibition. Inkjet prints are produced using micro droplets of ink sprayed onto print material.
Print Resolution: 720 DPI (Dots Per Inch).
Image
Permanence: Typically more than 70 years, subject to storage conditions.

Film transfers
DVD (with or without timecode)
This format is suitable for viewing and preview purposes only. It is not suitable for copying or editing of any kind. For preview purposes, DVDs can be provided with timecodes at the bottom of the screen. If you require a timecode, please request one when you place an order.
If you intend to use a DVD for display purposes, an additional user fee may apply. Should you require film footage for commercial use we recommend you purchase the material on Digital Betacam. Please contact the eSales Unit for more information.
Digital Betacam
This is a high quality format used for professional / commercial purposes. An additional user fee [link] may apply if the intended use of collection material involves dissemination or publication of any kind. Where high quality reproductions are supplied by the eSales Unit, conditions of use will also apply. Please contact the eSales Unit for more information.
Sound transfers
Subject to copyright you can order copies of recordings from the Memorial’s sound collection. Recordings are transferred onto audio CDs (16bit, 44.1 KHZ). An additional user fee may apply if the intended use of collection material involves dissemination or publication of any kind. Where high quality reproductions are supplied by the eSales Unit, conditions of use will also apply.
User fees explained
- What is a user fee?
- A user fee is a commercial use fee that the Memorial levies on all commercial use of all collection items. This is not a copyright fee. Regardless of a collection item’s copyright status, user fees are applicable to collection material used in a commercial way. User fees are in addition to production costs.
- Why does the Memorial charge a user fee?
- It is our responsibility to house, care for, and preserve the items within our collection. This includes images, films, and sound recordings. User fees contribute towards the costs of maintaining this collection.
- Do I have to pay the user fee and the production cost?
- Yes. User fees are in addition to production costs.
- Can user fees be waived?
- Yes. User fees may be waived for certain commemorative events, and for some organisations, e.g. schools, RSL branches, the Department of Veterans’ Affairs and the Department of Defence.
- To have user fees waived, individuals and organisations need to demonstrate that they will be using the Memorial’s collection material for commemorative purposes.

- Can production costs be waived?
- No.
- What collection items can be copied for commercial use?
- Photographs, art works, film footage, and sound recordings can be reproduced for commercial use, provided that, if they are protected by copyright, you have written permission from the copyright holder. They may be used in books, magazines, calendars, advertising, broadcast TV, merchandise, etc. You need to tell us your reason for use, and the Memorial needs to give you permission. You will need to agree to our terms and conditions.
- If I want to order a copy of a work in the public domain, do I still need to ask permission to use it commercially?
- Yes.
- If I purchase a copy of a collection item, does that mean I can do what I want with it?
- The purchase of any collection item does not convey any right to use it commercially or in public. Purchasing a reproduction of collection material is a separate process from requesting permission to use it in a program, product, or display. You will need to pay production costs and any applicable user fees before your order can be processed, and agree to our terms and conditions.

Copyright
Many of the items in the National Collection are protected by copyright. This means that the images (i.e. reproductions) that appear on our website can be downloaded for use in various prescribed circumstances. These circumstances are described as “fairdealing” in the Copyright Act 1968 and are explained in the Australian Copyright Council’s Fairdealing Information Sheet at copyright.org.au/publications/infosheets.htm#F. However, use of a reproduction falling outside these circumstances must have the permission of the copyright owner.
If the record shows that a collection item is still in copyright and the copyright holder is not the Australian War Memorial, then the Memorial will require evidence of copyright clearance before an order can be processed.
Every collection item displays a copyright status. Please see copyright terms for further information regarding the copyright status of a collection item.
Conditions of use
Where the eSales Unit supplies
you with a reproduction of collection material for personal or commercial use,
then conditions of use will apply. These conditions are designed to protect the
integrity of collection material, and are regardless of an item’s copyright.
You must read and agree to the conditions of use when you purchase a
reproduction of collection material. You will receive a copy of these
conditions once your purchase is complete.
This Agreement is made between and binds the following parties:
- The Australian War Memorial (the Memorial); and
- The User
1. Context
This Agreement is made in the following context:
The Memorial is responsible for maintaining a national collection of memorial items relating to Australian military history (the National Collection). The Memorial has agreed to supply items from the National Collection to the User on the terms and conditions set out in this Agreement.
2. Conditions of Use
2.1. Authorisation
2.1.1. The Australian War Memorial hereby authorises the User to access and use the National Collection Material as described on the terms and conditions set out in this Agreement and any reasonable directions provided in writing by the Memorial to the User.
2.2. Permitted Purpose
2.2.1. The User agrees only to use the Material for the stated Permitted Purpose. No further use or storage of the Material is to be carried out that is not directly associated with that Permitted Purpose.
2.3. Nature and scope of use
2.3.1. The User agrees only to use the Material in accordance with the Manner of Use for the relevant term, territory, and / or print run.
2.4. User Fees
2.4.1. The user is liable to pay the User Fees to the Memorial in relation to use of the Material authorised under this Agreement.
2.5. Moral rights - attribution of authorship and alteration
2.5.1. When reproducing or otherwise using the Material in accordance with this Agreement, the User is to display the Memorial reference numbers as printed on the order receipt in a reasonably prominent manner in connection with the Material. In the case of art images, caption details will be supplied by the Memorial and are to be printed or screened legibly in close proximity to the reproduction of the Material whether in print or moving image/film. Where the Material comes wholly or partially from Memorial's film collection and exceeds three minutes, the Memorial is to be credited in the completed production. The User must obtain the Memorial's prior written consent if departing from these methods of attribution or if they do not otherwise apply.
2.5.2. The User must obtain the Memorial's prior written consent to modify the Material irrespective of whether the Material is the subject of copyright protection so as to ensure that the author's moral rights are not infringed and/or to ensure the integrity of the National Collection. In particular, the User undertakes to ensure that images are not cropped, overprinted or altered in any way without the prior written approval of the Memorial. Where the Material is to be used as part of any design work a design proposal must be submitted for prior written approval by the Memorial.
2.5.3. The Memorial reserves the right to view on demand colour proofs of the Material produced by the User whether before or after publication (where applicable). For overseas publications this right may be exercised through any representative nominated by the Memorial.
2.5.4. The Memorial may deny or withdraw authorisation to use the Material in accordance with this Agreement in cases where the User's reproduction or use of the Material is deemed by the Memorial, in its absolute discretion, to be unsuitable or of an unacceptable standard.In these circumstances, the User acknowledges and agrees that it will have no right to recover the User Fees paid in respect of the Order and that it shall have no action against the Memorial for any losses suffered or costs or expenses incurred that arise directly or indirectly from the denial or withdrawal of authorisation to use the Material under this Agreement.
2.6. Copies sent to Memorial
2.6.1. Within fourteen (14) days from the publication or production of the Material by the User or such other time as agreed in writing by the Memorial, the applicant agrees to supply the Memorial with one free copy of the publication or production (or three copies in the case of unit histories).
2.7. Acknowledgements
2.7.1. The User acknowledges that authorisation to use the Material under this Agreement does not grant exclusive rights of any kind or imply the transfer of any copyright in the Material to the User.
2.7.2. The User undertakes that it will not directly or indirectly challenge the ownership or authorship status of the Material (whether or not copyright subsists in the Material) which is claimed by the Memorial.
2.7.3. The User agrees that, in order to protect the integrity of the National Collection, the User will not directly or indirectly facilitate reproduction or any other use of the Material by third parties including by provision to the parties of copies, disks and other media from which the Material can be reproduced. To this end, the User will inform any interested third parties of the requirement to obtain the Material directly from the Memorial or using the Memorial website.
2.7.4. The User agrees not to sub-licence its rights under this Agreement without the prior written consent of the Memorial.
2.7.5. The User acknowledges that its payment of User Fees under this Agreement is independent of the copyright status of the Material.
2.7.6. The User must immediately notify the Memorial if it detects or reasonably suspects any unauthorised third party use of the Material, and if requested to do so, will provide reasonable assistance to the Memorial in the conduct of any infringement proceedings brought against any such third party or as otherwise agreed between the parties.
2.7.7. The User may not transfer the whole or any part of its rights under this Agreement without the prior written consent of the Memorial.
2.7.8. The User is not by virtue of this Agreement an officer, employee, partner or agent of the Memorial, and agrees not to misrepresent its relationship with the Memorial.
2.8. Third party copyright
2.8.1. In cases where copyright subsists in the Material and that copyright is owned by a party other than the Memorial, the User warrants and represents that it has obtained or will obtain:
a. written permission from each copyright owner or their representatives to use the Material in accordance with this Agreement; and
b. written consent from each author of the Material or their representatives to use the Material for the Permitted Purposes and in accordance with the nature and scope of use stated in this Agreement so as to prevent infringement of any moral rights of the author, including the right of integrity of authorship and the right of attribution of authorship.
2.8.2. The User indemnifies the Memorial from and against any action claim or proceeding whatsoever arising directly or indirectly from the User's use of Material under this Agreement in respect of which copyright is owned by a party other than the Memorial.
2.9. Disclaimers
2.9.1. To the extent permissible by law, the Memorial expressly excludes any warranty relating to:
a. the copyright status of the Material including whether or not the Material is the subject of copyright protection; and
b. the non-infringement of third party rights (including copyright and moral rights) arising from use of the Material.
2.10. Indemnity
2.10.1. The User hereby indemnifies the Memorial, its employees, agents and authorised users from and against any claim, liability or cost arising directly or indirectly in connection with any breach by the User of this Agreement.
2.11. Termination
2.11.1. The Commonwealth shall have the right to terminate this Agreement and the authorisation granted under clause 2.1 immediately by notice in writing to the User if the User fails to perform or observe any of the terms of this Agreement and fails to remedy the default within thirty (30) days of the issuance of a notice from the Memorial.
2.12. Effect of expiry or termination of the Agreement
2.12.1. Unless otherwise agreed in writing by the parties, the User must cease using the Material within thirty (30) days of the expiry or earlier termination of this Agreement, or such other period as agreed between the parties, whichever is the latest, and comply with any reasonable directions of the Memorial in dealing with any copies or reproductions of the Material.

Your postage and handling charge depends on the items you order, and the method of delivery you select.
Shop items and Collection items have different sets of charges. Shop items include books and other merchandise. Collection items include image reproductions (scans and prints).

International orders
Customs clearance can add to the above timings and are beyond the Memorial’s control. Any fees, tariffs, or duties associated with international delivery are the responsibility of the customer.
Returns and Refunds
Goods supplied through the Online Shop are considered to be firm sale. Please choose your purchases carefully, and check your order details before making payment.
NOTE: Refunds and returns are not possible for Collection material. Please contact the eSales Unit for further information.
Returns will not be accepted for any change of mind, unless the goods are accompanied by an authorisation for return issued by the eSales Unit. Goods must be received back at the Australian War Memorial in original condition for a full credit / refund to be forthcoming. Goods not in original condition will incur a surcharge of 50% of the original purchase price plus postage.
Due to the high administration costs of processing refunds, we are unable to provide refunds for amounts of $5.00 or less. These monies will be regarded as a donation to the Memorial, and will be used in the further preservation of the Memorial’s National Collection. If you require a receipt for this donation, please contact the eSales Unit for further information.
